Probate and Estate Administration
After a person dies, his or her property, assets and personal effects must be passed on to the beneficiaries, or heirs, named in the Will. If there is no Will, the persons receiving assets are designated by State law. "Probate" is the legal name given to this process. Generally, a Will is filed with the court and the person chosen by the deceased in the Will is appointed as the Executor. The Executor then steps into the shoes of the person who has died and works with an attorney to publish notice of the probate proceeding, pay off all the legitimate debts of the deceased, pay any taxes that become due, and then transfer the property of the deceased in accordance with the instructions contained in the Will.
